Your Right to Use the Site and Its Contents
This Site is only for your personal use. You may not distribute, exchange, modify, sell or transmit anything you copy from this Site, including but not limited to any text, images, audio and video, for any business, commercial or public purpose. As long as you comply with the terms of these Terms and Conditions of Use, PathwayElectronics.com. grants you a non-exclusive, non-transferable, limited right to enter, display and use this Site. You agree not to interrupt or attempt to interrupt the operation of this Site in any way.
Ownership
All materials on this Site, including but not limited to audio, images, software, text and video clips (the "Content"), are protected by copyright under U.S. copyright law, international conventions, and other copyright laws. You cannot use the Content, except as specified herein. You agree to follow all instructions on this Site limiting the way you may use the Content. There are a number of proprietary logos, service marks and trademarks found on this Site. By making them available on this Site, PathwayElectronics.com is not granting you any license to utilize those proprietary logos, service marks, or trademarks. Any unauthorized use of the Content may violate copyright laws, trademark laws, the laws of privacy and publicity, and civil and criminal statutes.
Customer Contact Information
Customer is responsible for providing a valid shipping address, i.e. one that is recognized as valid by USPS at www.USPS.com. In addition, Customer must supply valid email address to which it can receive email sent by us. We are not responsible for communications you do not receive if your email address is incorrect, your mailbox is full or if you have a filter that will not accept email sent to us. In that case, you must contact us if you want confirmation that your order has been processed or shipped or log into your account for status confirmation.
Sales Tax
Pathway Electronics collects 7 % sales tax for items shipped to New Jersey. Please note that International customers are responsible for all applicable taxes, customs and import duties of the destination country.
Shipping Errors
If an incorrect item is shipped, upon receipt of your return item (please request an RMA), we will reship the appropriate item for no charge and issue you store credit for the return shipping (the lesser of actual postage or the amount initially charged customer for S&H). Of course, there is no restocking for incorrect items, otherwise, the return process is the same for other returns.
Please note that we are not responsible for delivery times, particularly during holiday periods once we have placed your item with the carrier. We ship using USPS or UPS only. We only calculate processing time or an approximate ship date. Please email us if you have questions regarding a specific order or need an approximate ship date.
Out of Stock
Some of our items are so popular that we occasionally run out of stock before we can post the information to our website. Your online account will show the item as Increasing Status or cancelled if it has been discontinued or will not be available. We will attempt to notify you, but please be aware, that in some instances, we are not aware that an item is on backorder until we receive a shipment from a designer or manufacturer. You may want to check your account online or email us if you have a question about your order's status.
Disputes:
Any dispute relating in any way to your visit to Pathway Electronics or to products you purchase through Pathway Electronics, shall be submitted to confidential arbitration in New Jersey, except that, to the extent you have in any manner violated or threatened to violate Pathway Electronics' intellectual property rights, Pathway Electronics may seek injunctive or other appropriate relief in any state or federal court in the state of New Jersey, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrators award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.
Governing Law:
Transactions between you and PathwayElectronics.com, and any disputes arising between you and PathwayElectronics.com related to any interaction between you and PathwayElectronics.com, including but not limited to claims relating to the content of its catalogs and Web site, shall be governed by and construed in accordance with the laws of the State of New Jersey without regard to the laws regarding conflicts of law. If any provision of this agreement shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.
Title - Risk of Loss:
Title to items being purchased passes from PathwayElectronics.com to purchaser at the time of shipping. Customer takes on full liability for safety and validity of delivery address given to us at the time of purchase. PathwayElectronics.com will not incur any forwarding costs on shipments. PathwayElectronics.com shall not be responsible for damages or delays resulting from Acts of God, war, riot, seizure, terrorist activities, embargo or other acts or events outside of the reasonable control of PathwayElectronics.com.
Return Policy
If for any reason you are not satisfied with a product, please contact us before sending the item back. Since we deal with several sources, we will need to send you proper instructions on how and where to return the item(s).
We guarantee that all products you buy are free of defects or you may return it immediately for a new replacement. If your item was damaged during shipment, please contact us and we will send you proper instructions on how to file a claim. If you are not satisfied with your item, you may return it to us within a period of 30 days. Shipping cost is non-refundable for undelivered, unclaimed, returned and refused packages, unless we made an error.
When returning an item, please make sure to use all the original packaging wherein the shipment has come to you, with all accessories and owners manual. Do not write, stick or glue anything on the product package that can damage the package. You can include a separate letter to explain your returning reason with a reference to the RMA number.
There will be a 25% restocking fee on non-damaged items that are returned in damaged package. If a shipment is refused at the door or cannot be delivered for whatever reason we will deduct these fees from the refund which will be added to the normal restocking fee.
Typographical Errors
In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information received from our suppliers or from staff error, we shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. We shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, we shall immediately issue a credit to your credit card account in the amount of the charge. In order to capture as much detail in our images for your benefit, actual products size may be different than the size they appear in the site.
